ご利用規約 TERMS OF USE

この利用規約（以下、「本規約」）は、株式会社エイチダブル（以下、「当社」）が提供するウェブサイトおよび関連サービス（以下、「本サービス」）の利用条件を定めるものです。本サービスをご利用になる前に、本規約をお読みいただき、同意された場合のみ本サービスをご利用ください。

第1条（適用）

本規約は、本サービスの利用に関する一切の関係に適用されます。利用者（以下、「ユーザー」）は、本規約に従って本サービスを利用するものとします。

第2条（利用登録）

  1. ユーザーが本サービスを利用するには、所定の登録手続を行う必要があります。登録が完了した時点で、ユーザーと当社の間に本規約に基づく利用契約が成立します。
  2. 当社は、利用登録の申請に対して、承認を拒否する場合があります。その場合の理由は開示いたしません。

第3条（ユーザーIDおよびパスワードの管理）

  • ユーザーは、自己の責任において、ユーザーIDおよびパスワードを適切に管理するものとします。
  • ユーザーIDおよびパスワードの第三者による使用によって生じた損害について、当社は一切の責任を負いません。

    • 第4条（禁止事項）

    ユーザーは、本サービスの利用にあたり、以下の行為をしてはなりません。

    1. 法令または公序良俗に違反する行為
    2. 犯罪行為に関連する行為
    3. 本サービスのサーバやネットワークの機能を妨害する行為
    4. 当社のサービス運営を妨害する行為
    5. 他のユーザーに関する個人情報等を収集または蓄積する行為
    6. 不正アクセス行為
    7. その他、当社が不適切と判断する行為

    第5条（サービスの提供停止等）

    1. 当社は、以下の場合には、ユーザーに事前に通知することなく本サービスの全部または一部の提供を停止または中断することがあります。
      • 本サービスの保守点検または更新を行う場合
      • 天災等の不可抗力により、本サービスの提供が困難となった場合
      • その他、当社が本サービスの提供が困難と判断した場合
    2. 当社は、本サービスの提供停止や中断により、ユーザーまたは第三者が被ったいかなる不利益や損害について、一切の責任を負わないものとします。

    第6条（利用制限および登録抹消）

    1. 当社は、以下の場合には、事前の通知なく、ユーザーに対して本サービスの利用を制限し、または利用登録を抹消することができるものとします。
      • 本規約に違反した場合
      • その他、当社が本サービスの利用を適当でないと判断した場合
    2. 当社は、本条に基づき当社が行った行為により、ユーザーに生じた損害について、一切の責任を負いません。

    第7条（免責事項）

    1. 当社は、本サービスに事実上または法律上の瑕疵（安全性、信頼性、正確性、完全性、有効性、特定の目的への適合性、セキュリティなどに関する欠陥、エラー、バグなど）がないことを保証しません。
    2. 当社は、本サービスの利用に関連してユーザーに生じたあらゆる損害について、一切の責任を負いません。ただし、消費者契約法における適用がある場合は、この限りではありません。

    第8条（サービス内容の変更等）

    当社は、ユーザーに通知することなく、本サービスの内容を変更または終了することができるものとし、これによってユーザーに生じた損害について一切の責任を負いません。

    第9条（利用規約の変更）

    当社は、必要と判断した場合には、ユーザーに通知することなくいつでも本規約を変更できるものとします。

    第10条（通知または連絡）

    ユーザーと当社との間の通知または連絡は、当社が定める方法によって行います。当社は、ユーザーから変更届けがない限り、現在登録されている連絡先へ通知または連絡を行い、これらは発信時にユーザーに到達したものとみなします。

    第11条（準拠法・裁判管轄）

    本規約の解釈にあたっては、日本法を準拠法とします。本サービスに関して紛争が生じた場合には、当社の所在地を管轄する裁判所を専属的合意管轄とします。

    These Terms of Use (hereinafter, "these Terms") stipulate the terms of use of the website and related services (hereinafter, "these Services") provided by HC-Double Co., Ltd. (hereinafter, "the Company"). Please read these Terms before using the Service and use the Service only if you agree to them.

    Article 1 (Application)

    These Terms apply to all relationships related to the use of the Service. Users (hereinafter, "Users") shall use the Service in accordance with these Terms.

    Article 2 (Registration)

    1. In order for Users to use the Service, they must complete the designated registration procedure. Once registration is complete, a contract of use based on these Terms will be established between the User and the Company.
    2. The Company may refuse to approve an application for registration. In such cases, the reason will not be disclosed.

    Article 3 (Management of User ID and Password)

  • Users shall properly manage their user ID and password at their own responsibility.
  • The Company shall not be liable for any damages caused by a third party's use of the user ID and password.

    • Article 4 (Prohibited Acts)

    Users must not engage in the following acts when using this service.

    1. Acts that violate laws, regulations, or public order and morals
    2. Acts related to criminal activities
    3. Acts that interfere with the functioning of the servers or networks of this service
    4. Acts that interfere with the operation of our services
    5. Acts of collecting or storing personal information, etc., of other users
    6. Acts of unauthorized access
    7. Any other acts that our company deems inappropriate

    Article 5 (Suspension of Service Provision, etc.)

    1. Our company may suspend or interrupt the provision of all or part of this service without prior notice to users in the following cases.
      • When maintenance, inspection, or updates of the Service are performed
      • When it becomes difficult to provide the Service due to force majeure such as natural disasters
      • When the Company determines that it is difficult to provide the Service
    2. The Company shall not be liable for any disadvantage or damage suffered by the User or a third party due to the suspension or interruption of the Service.

    Article 6 (Restrictions on Use and Cancellation of Registration)

    1. The Company may, without prior notice, restrict the User's use of the Service or cancel the User's registration in the following cases.
      • When the User violates these Terms
      • When the Company determines that the use of the Service is not appropriate
    2. The Company shall not be liable for any damage caused to the User by the actions taken by the Company under this Article.

    Article 7 (Disclaimer)

    1. The Company does not guarantee that the Service is free from factual or legal defects (such as defects in terms of safety, reliability, accuracy, completeness, validity, suitability for a specific purpose, security, etc., errors, bugs, etc.).
    2. The Company shall not be liable for any damages incurred by the User in connection with the use of the Service. However, this does not apply if the Consumer Contract Act applies.

    Article 8 (Changes to the Service Content, etc.)

    The Company may change or terminate the content of the Service without notifying the User, and shall not be liable for any damages incurred by the User as a result of this.

    Article 9 (Changes to the Terms of Use)

    The Company may change these Terms at any time without notifying the User if it deems it necessary.

    Article 10 (Notice or Contact)

    Any notice or contact between the user and the Company will be made in the manner specified by the Company. The Company will notify or contact the currently registered contact information unless the user notifies the Company of a change, and such notice or contact will be deemed to have reached the user at the time of sending.

    Article 11 (Governing Law and Jurisdiction)

    The interpretation of these Terms and Conditions shall be governed by Japanese law. In the event of a dispute regarding the Service, the court with jurisdiction over the Company's location shall have exclusive jurisdiction.
